State Board of Elections funding for County Board of Elections (CBE) contracts with HAVA Grants for hardware maintenance and software licenses of county voting systems will expire on July 1, 2012.
ES&S began mailing Maintenance Package Agreements to CBEs on or about Feb. 27, 2012.
N.C. General Statute 163-165.9 describes the powers and duties of county board of elections regarding voting systems. Section (b) 2 states:
The county board of elections shall annually maintain software license and maintenance agreements necessary to maintain the warranty of its voting system. A county board of elections may employ qualified personnel to maintain a voting system in lieu of entering into maintenance agreements necessary to maintain the warranty of its voting system. The State Board of Elections is not required to provide routine maintenance to any county board of elections that does not maintain the warranty of its voting system. If the State Board of Elections provides any maintenance to a county that has not maintained the warranty of its voting system, the county shall reimburse the State for the cost.
The purpose of this memo is to confirm compliance with the county requirements to maintain warranty coverage of county voting systems.
Please forward a copy of your contract providing continuing voting systems hardware warranty and software licensing for the fiscal year starting July 1, 2012. Scan and email the completed contract to: electsystems.sboe@ncsbe.gov.
County boards of elections that have not signed a contract should send an email to electsystems.sboe@ncsbe.gov and provide an explanation of where you are in the process, and an estimated date that you will be able to submit a copy of your contract to this office using the above electronic method.
