This year, the day before the county canvass for the 2013 November Municipal election is Veterans Day (Monday, Nov. 11, 2013). If your office will be closed for Veterans Day, pursuant to G.S. § 163-258.12(a), UOCAVA ballots for the Nov. 5, 2013 general election are timely if received by mail no later than the end of the business day on Friday, Nov. 8, 2013. If your office is open on Veterans Day, then mailed UOCAVA ballots may still be accepted through the end of the day on this day (including ballots that were received by mail on Saturday, Nov. 9).
§ 163-258.12. Receipt of voted ballot:
(a) A valid military-overseas ballot cast in accordance with G.S. 163-258.10 shall be counted if it is delivered to the address that the appropriate State or local election office has specified by the end of business on the business day before the canvass conducted by the county board of elections held pursuant to G.S. 163-182.5 to determine the final official results. (b) If the ballot is timely received, it may not be rejected on the basis that it has a late postmark, an unreadable postmark, or no postmark.
